Terms and Conditions

1. Accepting the pictures and checking the quantity
a. Receipt of the pictures automatically assumes acceptance of these terms and conditions.
b. Auscape must be informed within 24 hours of any discrepancy in the images submitted and those listed on our submission note.

2. Variation of the terms
Any variation of these terms and conditions must be agreed in writing.

3. Returning images
a. Digital images submitted to you on CD-rom or DVD must be returned within 21 days of receipt. You agree to pay a holding fee of $5 per week for each CD-rom or DVD held beyond 21 days unless reproduction rights are purchased or a further free period is granted by Auscape. High resolution digital images transmitted to you electonically by us must not be stored on any electronic device beyond the license period. After this time, the electronic image must be destroyed.
b. Images submitted to you on film must be returned within 21 days of receipt. You agree to pay a holding fee of $5 per week for each image held beyond 21 days unless reproduction rights are purchased or a further free period is granted by Auscape.
c.If a film image is lost or damaged, the following fees will be charged:
AUD$1500 for each original image lost or damaged.
AUD$200 for each duplicate image either lost or damaged.

4. Specific use must be requested
You may not assume that any use of an image is available. Auscape will grant specific rights only after being notified by you of the intended use, providing this particular use is available. No duplicate scans may be made without permission from Auscape.

5. Reproduction Rights
a. After a fee has been agreed and an invoice issued there is a firm and binding contract for Auscape to grant reproduction rights and you to acquire them. If, after such invoicing, you request cancellation of the reproduction rights, a cancellation fee of up to 50% of the invoiced amount will be charged.
b. Auscape’s invoice will define the reproduction rights. Any use of any image outside the rights granted will constitute an infringement of copyright.
c. You agree to indemnify Auscape in respect of any claims or damages or any loss or costs arising in any manner from the reproduction without proper reproduction rights of any images supplied to you by us.

6. Copyright
a. Copyright of any image provided by Auscape remains with the photographer. Auscape will grant only a specific licence to use the image and not ownership of it.
b. Reproduction rights granted are to you only and may not be assigned, and no image submitted to you may be loaned or transferred to third parties except so that you can exercise the reproduction rights you are purchasing.

7. Additional fees and charges
a. Where a search has been requested and low resolution images supplied with no final usage resulting, a search fee of $60 +GST will be charged at Auscape’s discretion.
b. Where a search has been requested, high resolution images supplied and final usage cancelled, a scanning fee of $60 +GST will be charged at Auscape’s discretion. The scanning fee will be additional to any invoice cancellation fees that may also apply.
c. A research fee of $60 +GST may be charged for any submission of low resolution images where the client has requested Auscape to carry out an image search in its archive.
